Compliance & quality

What we check, and what we don’t claim.

Insurance calls are regulated. Here are the standards every call source, and every buyer, is held to, in plain words. It describes how we work. It is information only: not legal or compliance advice, and not a guarantee.

Who we are

A marketing company. Not an insurer.

  • Ringside Media LLC is a marketing services company. We are not an insurance agency, producer, broker or carrier.
  • We don’t sell, quote, recommend or bind insurance, and our phone menus never discuss plan benefits.
  • We are paid per call or per lead, never per policy sold.
  • We are not affiliated with or endorsed by Medicare, CMS, HealthCare.gov or any government agency.
  • Licensed agents on the buyer’s side handle every conversation about coverage.
  • We don’t give legal or compliance advice. Buyers and call sources answer for their own compliance and should take advice from their own counsel.

The standards

The standards, on every campaign.

Each one is written into our agreements, and every call source we route must meet it.

TrustedForm certificates

A TrustedForm certificate records what a consumer saw and did on a web form when they gave consent. We require one for every web-form lead and every transfer that started from a form. A consumer who dials from a TV spot or an ad never fills a form, so for true inbound calls the ad creative and the call recording are the record. We also accept Jornaya LeadiD where a buyer agrees.

OTP-verified phones

On web leads and form-based transfers, the consumer’s phone number is confirmed with a one-time passcode sent to that phone, so the person who gave consent controls the number.

TCPA consent

Where a consumer is called or texted, the Telephone Consumer Protection Act and state laws apply. Consent wording has to cover the buyer who makes the call, and we review it before a campaign starts. Call sources and buyers must honor opt-outs, and any outbound dialing must be scrubbed against federal, state and litigator Do-Not-Call lists.

Exclusive or shared, stated up front

Calls reach one buyer by nature. Leads are sold either exclusive (one buyer) or shared (a stated maximum number of buyers), and that is written into the insertion order before delivery. Reselling an exclusive lead is a breach. Aged leads are only ever sold as aged.

Call buffers and billable duration

A call becomes billable only after it lasts an agreed number of seconds. The buffer is set per line and per buyer, in the buyer’s insertion order.

Duplicate protection

A repeat caller inside the agreed window isn’t billable. Every call source has its own tracking number, so every call can be traced to where it came from.

Recording, with notice

Calls on our platform are recorded, and callers hear a recording notice at the start. Several states require every party’s consent to record. Recordings are available to the buyer for the calls it received.

Returns and credits

Buyers can return a call inside an agreed window for an agreed reason, and approved returns are credited back to the buyer’s balance.

Line by line

Extra rules for Medicare and ACA.

CMS · TPMO rules

Medicare

  • The third-party marketing organization (TPMO) disclaimer is given before any discussion of plan benefits, in ads and in the phone menu.
  • Transfers tell the caller they are going to a licensed agent.
  • A beneficiary’s information is not passed from one marketing organization to another without the beneficiary’s prior written consent to that hand-off.
  • Calls are recorded in full and kept for the period CMS requires.
  • No misleading use of the Medicare name, logo or card.
  • Aged Medicare data is reviewed separately, and isn’t sold without consent that covers the buyer.

Marketplace rules

ACA

  • No “$0 plan” or “you’ll always qualify” promises.
  • No cash, gift-card or other cash-equivalent incentives to call.
  • No websites or ads made to look like a government site.
  • Calls go only to agencies already registered with the Health Insurance Marketplace.

Vetting and review

Every call source, checked first.

No process catches everything. When we find a problem, we pause the traffic and tell the affected buyer.

  • A review of every call source before it goes live: identity, traffic sources, call type, consent proof, compliance and operations.
  • Sample recordings and recent stats reviewed before any calls are routed.
  • New call sources start on a small, capped test in business hours, in the buyer’s licensed states, before any scale-up.
  • Recording reviews during the test and spot checks after it.
  • Fraud signals we watch: call lengths bunched just past the buffer, repeat caller IDs, area codes outside the campaign’s states, unusual spikes at night, and callers who don’t know why they called.
  • No incentivized callers, bots, call farms, or aged data passed off as live.
  • Consent and compliance warranties are in writing: every call source gives them to us, and we pass them through to the buyer.
